Maritimers Unite for Medical Marijuana Do you have a medical need for marijuana? Would you like to have an exemption from the federal government?

There are several ways to get the application kit needed to apply for a federal medical marijuana exemption.

Tips on filling out the application forms:-
You don't need to fill out all of the forms in the application kit. Make sure that you fill out every form that applies to you. Be sure to fill them out correctly. Email us here for help, advice or questions about filling out your paperwork. Photocopy all completed forms before mailing them to Health Canada. Your doctor should also keep a copy of either FORM B1 or B2 on your personal chart.

You must include two pictures of yourself that are a passport quality. Your local camera store/photo shop can take passport photos. FORM A states that your doctor must sign the back of one picture, however if both pictures are signed by the doctor, it will ensure that there are no mix-ups. This is important. Incomplete applications cause lengthy delays by Health Canada. Pictures must be redone every 5 years. You must keep track of when new pictures are required. Health Canada will not notify you when new pictures are needed. Not including photos when they are due will cause a delay in processing your renewal.

The Medical Marijuana Access Regulations changed in 2005. Doctors are now no longer asked to "recommend" the daily dosage of marijuana, the form, or the route of administration". Physicians now indicate the daily amount, form and route of administration that "the applicant intends to use."

Physicians no longer have to agree that the benefits of marijuana use outweigh the risks. The patient must still state that they have discussed the risks with the doctor signing FORM B. Some physicians still are not comfortable with this approach. To ease doctor's concerns, the Canadian Medical Protective Association (CMPA) developed a "Release Form for Medical Practitioners" for physicians completing FORM B.

Completing the release form is not needed to get an exemption, but the CMPA recommend that doctors who sign FORM B ask the patient to sign the "Release Form for Medical Practitioners". Many doctors don't know that this form exists. As far as HC is concerned this release form is NOT needed to process your exemption paperwork.

Although Health Canada has been pushing for a three gram/day limit, any daily recommendation for less than 10 grams is not usually a concern for Health Canada. If you have a larger medical need, make sure that your physician is 100% on board with your daily requirements as Health Canada have been phoning most doctors who recommend above 10 grams/day and will suggest to them that most exemption holders have a 3 to 5 grams daily limit. Many doctors change their minds about daily amounts as a result of this phone call. In all likelihood, you will not even be notified until your exemption arrives in the mail and the amount has been lowered. FORM B MUST be signed by your doctor in order for your exemption to be approved, so start by getting the appropriate FORM B completed. Form B1 is for patients with MS, Spinal Cord Injury, Spinal Disease, Cancer, HIV/AIDS, severe Arthritis or epilepsy. Form B2 is for patients with other health conditions. Anyone needing FORM B2 MUST have been assessed by a medical specialist.

All applicants must fill out FORM A - an Authorization to Possess Marijuana (ATP). A patient with an ATP has three ways to get their medicine:

1) If you will be growing your own cannabis, fill out FORM C. It gives you a Personal Production License (PPL). Health Canada will tell you how many plants you can grow.

2) If you want to appoint a designated grower to grow your medicine, fill out FORM D. This is also called a Designated Production License (DPL) and it must be completed by the person who will be growing for you. FORM D requires that the person who you'd like to have grow your medicine:

1) have a criminal record check. completed. Possession charges do not disqualify you from obtaining a DPL.
2) provide two passport type pictures of themselves, signed on the back by both the grower and the patient.

3) If you want to buy cannabis from the government, fill out FORM E. Health Canada offers only one strain of cannabis. It cost $150 for a 30 gram bag. You do not have to purchase your medicine from Health Canada.

Fill out FORM E2 to buy seeds from Health Canada. The seeds are $20 for 30 seeds, for the single government authorized strain. NOTE: you do NOT have to buy seeds from the government. If you do buy seeds from the government you are only allowed to do so once.

FORM F is for an exemption holder with a PPL or DPL who wishes to grow at a spot separate from where they live. You must file this Property Consent in order to legally grow at that location. You will need your landlord's signature as their approval for your activities.

FORM R is only used after an initial exemption has been granted. Exemption holders do NOT have to fill out all of the forms again to reapply if nothing has changed from the last application. This shorter form will work if there have been no changes in your address, the amount of cannabis you use, or the doctor signing your form. Send your completed forms to Health Canada by registered mail, but do NOT request a signature as part of the registration process. Health Canada’s mail department cannot, and will not, sign for department packages, and your application will be returned. Sending the application by registered mail will allow you to track the receipt of your application by Health Canada.

The usual processing time for the application is 8-12 weeks. Some applicants have received their federal license in considerably less time. Renewals take the same amount of time as original applications. Calling Health Canada to ask about the status of your application may cause further delay.

If you read the Quick Guide and Information for Patients documents first, then you will be able to download the forms that are pertinent to the type of access that you are requesting. You will need to fill out the appropriate applications for Authorization to Possess, Licenses to Produce and for supply.

In 2005 the Medical Marijuana Access Regulations were amended removing the onus from physicians to "recommend" the daily dosage of marijuana, the form, or the route of administration. Physicians must indicate in the medical declaration, the daily amount, form and route of administration that "the applicant intends to use."

Physicians aren't required to declare that the benefits of marijuana use outweigh the risks. The amended regulations still require the applicant to declare that they have discussed the risks with the doctor signing the medical declaration. Some physicians may not be entirely comfortable with this approach.
To facilitate this, the Canadian Medical Protective Association (CMPA) has developed a "Release Form for Medical Practitioners", for physicians who complete a medical declaration under the Marihuana Medical Access Regulations Completing the form is not a requirement to obtain an authorization to possess marihuana for medical purposes, but the CMPA recommends that physicians who complete the medical declaration ask the applicant to sign a release from liability produced by the CMPA.
